Legally, U lost H1 if AP used

From what I know, legally, you lost your H-1B status after you used your AP coming back to US. But you can still work with a valid H-1B till it expires after your I-140 (or I-485) is denied.
Many people's experiences are that using AP is OK for your H-1B. It's using EAD that invalid your H-1B.
I am not sure if you can renew your H-1B after you used your AP. But I think it will be hard.
