Can L1 visa holder work while applying transfer to new company?

Has anyone had such experience or knowledge for such a case -
I intend to hire this person who has the exact skillsets my company needs. However, this person has a L1 visa working for another firm. He wants to join mine so, I am not sure if it's leagal to have him work while we are filing the petition to transfer to my company.

Appreciate it you can shed some light. Guessing is welcomed too but please indicate you are not an immigration lawyer.
