premium 140 is the only way

you should file h1b 7th year extension while EB3 Labor (RIR or NR)Pending.

now you already have Eb3 labor approved and could not do extention until your 140 approved.

your lawyer is right.

if your 140 is denied, labor is useless and no way to get h1b 7th year extension.
