xiaobaitu name check help

I got letter from FBI stating that name check result finalized on Mar 20 (starting Apr 2006)and was sent back to USCIS. however through April infopass, uscis said they didn't get it. Can i sue uscis with WOM? (I-485 pending over 1 year as derivative beneificary, primanry has card in hand)
