請問EB3 to EB2

我的情況是這樣perm (EB3) and I 140 in pending，但是現在EB3倒退的太厲害，所以想換成EB2.
我想問如果我在同一家公司the same position，重新辦perm(EB2) and I140,can i carry on the old perm (EB3)PD嗎？

If my company lawyer refuses to refile EB2 for me (since I am in the same position), what can I do? Can I hire my own lawyer?
