I am a fulltime student in some community college and will graduate at this December.My I-20 will be expired until 12/31,2009.My international student advisor informed me that I have to find a fulltime job on the first date of my OPT in 2008; otherwise I would need to register as a full time student on the first date of the winter semester of 2008 in my college . I doubt that whether this information is true. I have some friends who were F1 before and did not find a fulltime job on the first date of their OPT . Furthermore, they were not required to register as a full time student after their graduation.
I emailed a Policy Analyst in home security department if I have to register as a full time student on the first date of the winter semester of 2008 in my college if I could not find a full time job on the first date of my OPT ? He answered with "F-1 students are not required, by regulation, to have a full-time position on the first day of employment eligibility.Also, if you are still searching for employment at that point, you are not required to register for a full course of study. That said, you are limited to 12 months of practical training and must maintain your status so it is in your best interest to find employment as soon as possible."
However, my international advisor still insisted that I have to be registered as a fulltime student if I could not find a fulltime job on the first date of my OPT.She answered that different school has different rule for an international student.
As a F1 student, I have to be either a fulltime student or to work as a fulltime OPT. If I don't do either above job,she will report that I terminate my F1 status to the home security department.
Could any lawyer here help me with my case?
