回複：Urgent... fail in getting visa in the 3rd country.

That happened to my hu*****and more than 3 years ago when we went to Mexico for 3rd country visa. Mine was checked and his denied. We didn't have Mexico visa But the border INS let us in. Other people who had similar experience that day told us that, they were given a I-94 with 14 days valid period. So that he/she could come back and pack up to leave US.
So my suggestion is:
1. Ask Border INS for some mercy. That worked for us. He might get a temporary 14 days I-94 to return to US.
2 Ask Chinese embassy for help. I heard that someone run into this kind of trouble before. Actually it seems that he got arrested because he didn't have Mexico visa. Chinese embassy there got him out and he was able to go back to China.
