My wife also wants to relocate to my place, but she is not sure before talking with her manager. The situation is: when she talk to her manager, if her manager doesn't want her to relocate to my location and work remotely, it is quite possible that she may want to resign (or get laid off, who knows) in 2 to 3 weeks, and that means her H1-B is not valid at the time she left her current job.
So would you please suggest how long ahead of time do we need to prepare and file the H1-B to H-4 transfer so that there is no gap between the H1-B and H-4.
The situation is a little bit awkward: she can't file the H-B to H4 transfer too early, because if her manager agrees her work remotely, she can remain in H1-B. On the other hand, if she needs to resign, there will only be 2 to 3 weeks before she left the company to file the transfer application, and we are not sure whether it is long enough to finish.
Is there any grace period between H1-B and H-4? What do we need to do with the above situation?
Many thanks!
