Can my husband apply for H4 when my H1b renewal haven't been app

Hi! I ted my h1b renewal applications in mid Feb and haven't got the 797 form (approval notice). My old H1b visa was expired yesterday. So does anyone know if my hu*****and can apply for h4 visa before I got the 797 form? Thanks!
