I forego 'coz based on the information from Pacer I know in my district there's no chance for a case like mine to win. The U.S. Attorney and the court here have been well prepared to turn you down. It's only a waste of money, time, energy to beat a dead horse.

I would definitely give it a try if I were in CA or TX...
