It depends on your job security. If you can keep your job for more than 6 months, it is ok. But say if you is gonna lose job in one month, it might be risky. Because it is possible that CIS will ask for employment letter before they approve your I-485.

Since your nc is cleared, if you decide to sue, you don't even need to mention your NC status. Just sue CIS alone, and write down the amount of time your I-485 has been pending.
