green card in NY

my hu*****and is US citizen. we got married 3 years ago. we filed I485 and I130 in Aug 2001, and went to interview in July 2003. The interview officer was pleasant with us but she could not stamped my passport because my FBI's name checking was not ready at the time. She told us to go home and wait.
Now 8 months passed, we have not recieved anything. we went to the Immigration again and they told us they still don't have my name check info.. Am I gonna wait forever?
A lawyer told us for $2500 legal fee he will go to court with immigration to solve my case. is it true and necessary?
I really don't know what to do anymore. also i found out from FBI that they sent back my name check information to immgration 7 months ago. but immigration people denied this.
