as far as I know, there WAS a case got denied by USCIS because the plaintiff did not list FBI as defendant (just UCSIS), so USCIS deny that case saying that they can not do anything (NAME CHECK is stuck in FBI) but deny in 30 days, but I think it's a very rare case. maybe you need a lawyer to help you out now.
