xiaobaitu please help with H4 extension deny

My I-140 was approve last June. I-485 was denied because we didn't show up for the interview. So we went to the New York city office to reopen it. In the mean time my university sent application to extend my H1. It was approved. I don't have it now. But my hu*****and's H4 extension was denied. The reason is we went back home last Feb using AP. So in the letter it says he can go to a near entry port with my H1 approval notice and get an H4 on his passport. We live in New York. We can just go to the JFK airport to get the H4. Or it is OK for him to stay here based on the I-485 pending? His I-94 expires on 28 Feb. Plus it has been almost 5 month since he applied to renew his EAD card. Thank you very much for the answer.
