J1 Waiver

My hu*****and obtained J1 visa in UK where he obtained his uk PR. We are not sure if he need to apply for J1 waiver or not. He just got his advisory opinion letter from DOS which stated that he is not subject 2 years rule and he can change his visa status directly to USCIS. I also heard USCIS determine J1 waiver based on his place of birth. Are there anyboday know this question. Thanks a lot
