It depends on your current status and immigration officers’ discretion. I never got a clear answer on this. But here was my situation. I was J1 and then changed to F1 within the country. Prior to my landing, I didn’t have a white F1 I94, only a green I94 – the lower portion of the approval notice. So when I went to land last year, I consulted with advisors in my international student office. They insisted that I would need a new visa to come back to the States. I went to the US consulate in Toronto and got a 5-year multiple entry visa with no incidence at all. Because I had the new visa, I came back to the States with no problem. But I also heard people were able to come back to the States by using the green I94/approval notice. However, I was never able to confirm that. So I went with what my school ISO’s advice. My own experience over the years is that you probably will never get a sure answer on any immigration related issues. It depends on a lot of factors, and your luck to some extent.
