請教專家：一個很複雜的Case

我的基本情況是：

2004年6月遞交RIR EB3 LC 申請
2006年2月遞交PERM EB2 LC 申請
2006年5月PERM EB2 LC 批準
2006年7月遞交 EB2 I-140，8月批準

最近，我在2004年遞交的 EB3 LC也被批準。我在考慮遞交EB-3 I-140 然後再
把EB3 的Priority Date carry over 到EB-2的申請上來。

根據：
8 CFR § 204.5(e):
A petition approved on behalf of an alien under sections 203(b)(1), (2), or (3) of the Act accords the alien the priority date of the approved petition for any subsequently filed petition for any classification under sections 203(b)(1), (2), or (3) of the Act for which the alien may qualify. In the event that the alien is the beneficiary of multiple petitions under sections 203(b)(1), (2), or (3) of the Act, the alien shall be entitled to the earliest priority date. A petition revoked under sections 204(e) or 205 of the Act will not confer a priority date, nor will any priority date be established as a result of a denied petition. A priority date is not transferable to another alien.

我公司的律師認為：

1。因為我EB2的I-140比EB3早被批準。所以EB3 的Priority Date 不能被carry over 到EB-2的申請上來。
2。假如我遞交 EB3 的I-140 申請。 Priority Date將會變為2006年2月，盡管EB3 的LC是2004年6月遞交的。
因為：“A petition approved on behalf of an alien under sections 203(b)(1), (2), or (3) of the Act accords the alien the
priority date of the approved petition for any subsequently filed petition for any classification under sections 203(b)(1),
(2), or (3) of the Act for which the alien may qualify.”

我的問題是：

1。我公司的律師是對的嗎？
2。我怎樣才能利用我EB-3的Priority Date。
