急：請教

我的H1十一月三十日到期，我的學校已經為我遞交了延期申請，但是，現在還沒有批準。如果11/30前批不下來，
1。12/1後，我在美國還合法嗎？
2。我12月7日回國，想到北京去簽H1,如果簽不上，就用AP回來，請問這樣合法嗎？
