To use prior experience at the same company as qualifying experience, the previous job has to be substantially different (at a much lower level) than the current job. Our attorneys have maintained that at 50% of the weekly hours need to be dedicated to different duties. (Of course we are all just treading water here, and it depends on the official processing your case.) For example, if you were a professional before and now gets promoted to management and are filing for PERM in the management position, your prior experience at the same comopany may count.
