When you get I-797 from H1 approval, you have already or will be converting to H1B on the start date or approved date (whichever stated as the begin date on the H1 I-94.) Or if no H1 I-94 attached to I797, the re-entry date when you re-enter with H1 visa stamp is your H1 begin date. No I-539 is needed.
