請問這種情況，我的孩子能在美國上大學嗎？

我已遞交了！I140及I485（同時也將小孩的I485交了上去，他的I94已過期），目前I140未批，在等待中，在這種情況下他是否能上大學？
前幾天因帶他去考駕照，被拒，理由是他沒有合法的身份，因此我很擔心大學也不允許上，請教各位專家，是不是這樣，如果是這樣的話，有沒有其它的辦法。謝謝各位。
