一般來說，如果你的新雇主在你第一個H1仍然有效時，為你提出H—1B的申請，一旦提出，在還沒有批準前，你即可為第二個雇主工作，隻要你沒有非法打工的紀錄。

　移民局的條例規定，在第二個H—1B申請期間，於第一個H—1B過期日加10天，你依然算可入境身分（admissable），隻要你符合其他入境條件，例如，你沒有其他的不良紀錄，持有效護照等。
