The previous posting deals deals with the portability of I-140 under the circusntances as described in the two thwe situations.
Your case is the portability of the priority date. If the first I-140 has been approved and the I-485 has not been filed. You have to start a new PERM and file a second I-140 requesting that the priority date of the first approved I-1140 be retained. You must attach a copy of the first I-140 approval notice (Form I-797) to the new I-140.
