On one other occasion we had an approved Labor Certification that we never received. This was a PERM application. There is a procedure to file the I-140 and request DOL to send a copy of the Labor Cert to immigration. It wouldn’t affect your ability to file the I-485 concurrently.

So it looks like your lawyer can file I140/485 for you now....
