EB1b from a college, PD, 12,2005, and was transferred to NSC 05,2006. Just received the RFE letter, seems nothing for my background. However, they need a letter showing that I am offered a permanent position in the institute (I am a postdoc). This is the most difficult issue. I ask the international office what I need do, they told me nothing I can do but waiting, they will work on it. I do not know how they will work on it. I even did not see the cover letter when my case was sent initially.
However, they are right, what I can do is waiting………

OFFER OF A PERMANENT RESEARCH POSITION
Please a copy of the offer by XX University to XX of a permanent research position. 8 C.F.R. 204.5(i)(3). The document now requested is the actual offer of a permanent position issued by the Univ to the alien that will bring the beneficiary to the Univ, or change the alien’s existing employment status from that of temporary to permanent employment.
If THE OFFER IS NOT FROM THE UNIVERSITY ADMINISTRATION OR HR OFFICE
If the offer is not from the university’s administration, human resources office, Office of the Provost, or comparable authority, please additional evidence to establish that the employee issuing the offer is authorized by the university to commit it to a permanent employment relationship. Specifically, please a letter from the university administration or human resources office conforming that 1) the employee making the offer has authority to offer permanent employment on the university’s behalf, and 2) the university is aware of and supports the hiring of the beneficiary.
IF THE OFFER INDICATES EMPLOYMENT IS FOR A TERM SUBJECT TO REVENAL
Consistent with memorandum guidance issued June 6, 2006, the Service will evaluate whether employment that is for a term can be considered permanent within the meaning of 8 C.F.R. 204(i)(2). To allow for evaluation, please the following additional evidence.
1)For circumstances surrounding the job offer as well as the benfits attached to the position, a copy of the official university document that defines university polices and procedures for employment of academic/professional staff. The copy may be from a printed or electronic source. The entire document need not be ted, but all parts relating to the position offered the the alien and all cmparable (i.e. to tenured or tenure-track) research positions at the university should be ted.
2)To demonstrate intent to continue to seek funding, a letter from the university that corroborates its intent to continue to seek funding for the research involving the position offered to the alien; and
3)To demonstrate a reasonable expectation that funding will contine, please evidence that funding grants relating to research involving the position offerd to the alien have been renewed in the past.
