Re: Status inquiry about EB1 I-485 cases with priority date of 9/26/2005

XX, Xxxx (Principal, I-485 receipt number LIN-05-xxxxxxx, Axxxxxxxxx, DOB x/xx/xxxx)
XX, Xxxx (spouse, I-485 receipt number LIN-05-xxx-xxxxx, Axxxxxxxxx, DOB x/xx/xxxx)
XX, Xxxx (child, I-485 receipt number LIN-05-xxx-xxxxx, Axxxxxxxxx, DOB x/xx/xxxx)

Dear Sir/Madam:

Based on the following facts, I believe that our I-485 applications are more than 60 days out of your published processing date:

1. My I-485 application was ted on x/xx/xxxx along with my NIW I-140 petition, which was approved on xx/xx/xxxx.
2. The University of Xxxxxxx ted an EB1B – Outstanding Professor or Researcher I-140 petition for me on x/xx/xxxx, which was also approved on xx/xx/xxxx.
3. My attorney requested to transfer our I-485 applications to the approved EB1B I-140 on x/x/xxxx and the letter was delivered to your center on x/x/xxxx.

Enclosed please find:

1. Two approval notices of the above mentioned I-140 petitions (NIW and EB1B).
2. Three finger print notices for my family members, with biometrics processing stamps.
3. Copy of the letter requesting the transfer of our I-485 applications to the approved EB1B I-140 petition.
4. Copy of the return receipt of the above letter indicating its delivery to your center on x/x/xxxx.
5. Copy of the letter I received after a telephone inquiry about my status, which contains several mistakes. e.g., it listed my I-485 receipt number, but my wife’s name; and it didn’t take into account the above mentioned transfer of the applications to the approved EB1B petition.

Your immediate processing of the applications will be very much appreciated.
