First, you definitely need a lawyer since you are running out of time.

My I140-NIW was denied after RFE, and I appealed. However, the Center changed it to a MTR and granted me approval after a month or so. I believe that the Center has something to lose if their decision is overturned by the Administrative Review Unit.

In retrospect, you should have renewed your H1B before your I140 was approved.
