Your situation is very tough!!!
1)your H1-B will be expired, you will have no visa in a week
2)How could you be so confident that your EB-1a would be approved!!!?
3)if you appeal, your EAD will be invalid at the time point your I-140 is denied (consequently, I-485 is denied----this is for EAD), so appeal do not mean you have valid EAD. You should know your EAD actually is invalid at this time point
4)The best way for you is to file EB-1B (Employment based) with concurcent filing I-140 and I-485, at the same time applying new EAD card. Additionally, you had better file I-140 (NIW) at the same time after you file EB1-b.
5)Even if you file all the petition, your H-1B will be expried, you will have to leave US to wait your new EAD card, I am not quite sure about this point. H1B can only be extended before one year at the time point you your I-140, why did you prepare well for the situation before???
