各位大蝦,最近有人在範律師的網站問,H-1是否可延第八年如果第七年底I-485還沒FILED(也就是說LC還在等,這一點請注意).回答是"NO".我當時大吃一驚.我的理解一直在LC等了365天後從第6年延到第7年,如果第7年底LC還是在等,就可以一年一年地延,直到LC被否(批準就不說它啦).這也是我從各個律師網站看到的解釋,包括範律師自己的網站:(注意最後一段)http://www.fan-law.com/getArticle.cfmarticleID=334&language=1

Section D "One-year extensions of the beneficiary's H-1B status may continue until one of the events outlined in section B of this memo occurs."
