Am I out of status

My current visa expires on Sep 30 and I send out my application to switch my visa to H4 just yesterday (Sep 27). Prior to this, my employer filed application for my H1 visa renewal but I still decide to quit my job after Sep 30 (I haven't got the new visa yet). My question is: am I out of status even if the CIS recieve my H1 to H4 application before Sep 30? Do I need to get the receipt notice before Sep 30 in order to avoid gap? I know it takes more than a month for CIS to issue the receipt. If I stay in the US, by the time I actually get the receipt, am I out of status for one month?
