Your lawyer is right. Get an AP as backup first.

I assume that you only have a H4 approval notice with I-94. So you need to apply for a H4 visa from an US oversea consulate. You can not reentry the country on H4 approval notice. The risk of H4 visa application is very remote. But having an AP as backup will give you the maximum security.
