PLease Help!!!! Thanks a lot!!

Dear friends,
I found a RN job in a nursing home recently. The employer will sponsor my GC application and the lawyer filed the 140, 485, 765, 131 at end of August after 10 days of job posting by nursing home. But today my laywer told me the case was denied because it was filed too soon after job posting. it shold be 30 days after it. And we need to refile the case again. :( Is it true for Schedule A nurse?
Any friend know about this and can help us for this? and I appreciate your time and suggestion a lot!
