My wife did her F-1/OPT -> H1B back in July and the I-797 she got doesn't have I-94. Instead, the I-797 says "The above petition has been approved and notification has been sent to the listed consultate........The alien may use this portion when applying for a visa at an American consulate abroad, or if no visa is required, when applying for admission to the US".
That I-797 is for people who are outside of US. My wife has been here in the US for the past five years. My lawyer already sent USCIS a letter and I also called customer service asking for the I-94 card with no response yet.
I'm just worried this I-797 doesn't really mean my wife's status got changed because it doesn't have I-94 card. How can we ask USCIS to correct this and send her a new I-94 card? Her OPT will expire in Dec 2006.
Any suggestion is appreciated.
