please help: problem of gap between two H1Bs

在國家實驗室，因fund問題需換工作到一個非營利組織作研究。舊工作到本月底結束，新工作的開始日期是10月中旬。舊的H1B status 一月到期，可以用現在的H1B在新單位工作嗎？

如果不可以，在馬上遞交申請後是否可以在美國等待？這樣的gap影響將來的485申請嗎(140NIW 已批)？
