Recently got RFE from NSC for my NIW 140 application. Submiited 09/2005 to VSC and transferred to NSC this May.
The details of the RFE as follows:
1. Please any available additional documentary evidence, that, as of the petition priority date, you had a degree of influence on your field that distinguishes you from other scientists with comparable academic/professional qualifications. The evidence may include, for example, copies of addition published articles that cite or otherwise recognize your achievements. Similarly, evidence of official recognition conferred on you by governmental entities or professional organizations may also be ted. The letters you ted in support of your petition fail to establish that, through your research, have influence on your field.
2. To be considered in the national interest you must make a showing significantly above that necessary to prove the “prospective national benefit” required of all aliens seeking to qualify as “exceptional”. Exceptional is defined under Service regulations “a degree of expertise significantly above that ordinarily encountered in the sciences, arts, or business.”
3. You must persuasively demonstrate that the national interest would be adversely affected if a labor certification were required. You must demonstrate that it be contrary to the national interest to potentially deprive the prospective employer of your services by making available to U.S. workers the position you seek. If self-employed, you must also establish the national interest would be adversely affected if a labor certification were required.
4. You must establish you have a past record of specific prior achievement which justifies projections of future benefit to the national interest. You must establish, in some capacity, your ability to serve the national interest to a substantially greater extent than the majority of your colleagues. You must demonstrate to some degree your influence on your field of employment as a whole.
If this a common RFE? Seems to me, they mainly challenging the 3rd point of NIW, "The foreign national will serve the national interest to a substantially greater degree than would an available U.S. worker having the same minimum qualifications". Is my understanding right?
Can any one give me suggestions on how to reply this RFE?
