I started to thinking about file the lawsuit against USCIS (or FBI, whoever). Since most of those cases are for citzenship applications, i am wondering if there is any condition for green card (I485).
1) How long your 485 case has to be with USCIS?
2) How long your name check has to be with FBI?
3) Is the processind date (NOT PD) has to be current?
for my case, I have my NIW filed on Sep 2003 and approved on June 2005. My 485 filed on July 2005 (VSC, process date not yet current). Name check initiated July 25th,2005 and still pending.
(my wife's name check was initiated on the same day and got cleared round Sept 20,2005. unfortunately she is the derivative applicant)
Can I file the lawsuit? Can anyone she a light? Thans a lot.
