"Upon consideration, it is ordered that your application for permanent residence, Form I-485, to adjust your status to that of lawful Permanent Resident be denied for the following reason(s).
The category that the applicant checked states the applicant has "An immigrant petition giving me an immediately available immigrant visa number has been approved".
Title 8, Code of Federal Regulations, section 245.1(a), states in pertinent part:
"General. Any alien who is physically present in the United States, except for an alien who is eneligible to apply for adjustment of status...may apply for adjustment of status to that of a lawful permanent resident of the United States if the applicant is eligible to receive an immigrant visa and an immigrant visa is immediately available at the time of filing of the application..."
Your I-140 was denied today. You are not a beneficiary of an immigrant visa petition available at the time you filed the instant application (Form I-485). Pursuant to 8 CFR245.1(a) you are ineligible for benefits under section 245 of the Immigration and Nationality Act, as amended [8 U.S.C. 1255]"
