Please help: H1B transfer.

I am in H1B currently and is changing my job. I got the offer letter from the new company about 2 weeks ago and the H1B transfer process was initiated also at that time. Now that I was told by the new company that they haven't heard anything from INS yet, nor did their checks being cashed by INS. Can someone please tell me under what circumstances I can start work for the new company legally? Please help, as I have already given my current company the termination notice. Thank you.
