EB-1a綠卡申請的一些體會
我的綠卡申請, 是一個多星期的瘋狂準備和十個月多的等待. 我在這裏談一些體會, 是想與大家分享心得. 我不是移民專家, 也隻辦過自己的個案, 我所寫的, 各位隻當是一家之言. 在決定不請律師自己辦EB-1a之前, 我覺得有兩件事先要評估. 第一是自己的個案有多強. Is your case strong enough? 第二是自己的英文有多好. Is your English good enough? 畢竟好律師的專業知識和辦案經驗是無可取代的.
我在中國的醫學院拿到學士, 碩士和博士學位, 在加拿大的實驗室幹過幾年, 老板是一個非常優秀的科學家. 我所研究的是一種幾乎人人知名, 對人類健康和全球畜牧業影響甚巨, 而對於普通人又有神秘感的疾病. 作為第一或第二作者, 我在好雜誌上發表了約十篇文章, 被引用超過650次, 其中一篇Nature的文章, 被ISI統計在所有該疾病研究論文中引用率為第七位. 加上其他中英文論文, 總共30多篇. 在加拿大, 我先拿綠卡, 後成為公民. 因為加拿大工作不好找, 就到美國東部一所大學作了助理教授. 先用TN工作, 去年8月才改拿H1. 原打算慢慢收集推薦信和所需材料, 再遞交綠卡申請.
去年9月14日, 一位同事告訴我, 綠卡申請要排期了. 排期? 從來沒聽說過, 而且是倒退5年. 這下子急了. 想請律師, 估計他們的案件早已堆積如山, 我也沒有時間去與他們聯絡. 隻好自己收集證據, 撰寫材料, 為不同的推薦人起草推薦信, 體檢, 填表, 終於在9月28日寄出了所有申請I-140和全家I-485的材料. 總算幸運, I-140在今年1月初批準, I-485在今年8月中批準. 之後不到一個星期, 全家的綠卡就收到了.

我想說說我在Cover letter和petition letter的一些寫法.
1. Cover letter 第一段: 開宗明義一句話: I am writing to apply for permanent resident status in the United States of America as a biomedical research scientist in the category of EB-1-1, an Alien of Extraordinary Ability Program. 第二段: 簡單介紹自己的學曆, 職務, 研究領域. 結束以: In my research area, I have made significant contributions, which have obtained highly praise from national and international distinguished professional experts. 第3段: 簡單介紹自己的工作單位. 如果工作在大學或著名研究所, 會增加移民官對申請材料的信任感. 第4段:列舉所提供證據的目錄. 最後別忘了說感謝.
2. Memorandum in support of petition for permanent resident visa to be classified as an alien of extraordinary ability
前言: 說明為什麽提出申請和自己的申請資格.
I. The extraordinary ability alien requirements 列舉在§203(1)(b)(A), 8 U.S.C §1153 of the Immigration Act of 1990中對extraordinary ability alien的要求.
II. My fulfillment of the extraordinary ability requirements
前言: 有這樣一句話: Although I have yet to receive an award such as Nobel Prize, I believe that I have overqualified with respect to the alternative requirements.
A.Receipt of national or international award 列舉所有有用的獎項, 包括國內的部級獎, 國際發明獎, 在北美的fellowships, Who’s who的收錄條目, 等等. 還要描述其重要性, 為什麽是國家級或國際級的獎項.
B.Memberships associations 列舉至少3個學會會員. All of these professional associations require outstanding achievements of their members in the field of expertise as judges by other experts in that field.
C.Published materials about my work 指出自己在哪些研究領域裏有什麽文章發表在什麽雜誌上, 那些文章最重要, 被引用了多少次, 那些綜述文章稱自己的某篇文章為a landmark paper或列為”of outstanding interest.
D.Participation by me as a judge of other scientists’ work 列舉哪些雜誌請自己作審稿人. 還特別列舉了一次英國廣播公司(BBC)在製作一個麵向全世界的科學節目前邀請自己評判某著名科學家所作研究的經曆.
E.Original scientific or scholarly contribution 分節較詳細地列舉自己在不同研究課題中的貢獻和成就. 既要用移民官能看懂的通俗語言, 使其了解自己的研究工作, 也要用較為專業的名詞, 顯得高深與重要, 使其產生尊重感.
F.Authorship of my scholarly articles 再簡略談一下文章與書籍章節的發表.
G.Display of my work at exhibition 提及所參加學術會議上的展示或發言. 列舉被邀請在各大學與研究所作的學術演講.
H.Participation in organization of distinguished reputation in a leadership role 列舉自己在不同單位和課題中的領導或重要作用. 引用推薦信中的話來加強證據.
III. I will continue my work in the field of expertise 強調自己將繼續在相同領域作研究工作, 列舉所有用以支持自己研究的基金名稱.
IV Conclusion 強調自己是合資格的申請人. 結束以: Based upon the foregoing memorandum and supporting exhibits, I respectfully request that my petition be granted.
體會: (1) 不要不好意思讚揚自己, 而是要在有事實的基礎上適當地拔高. (2) 所有列舉的證據都要編上編號, 讓移民官可以很容易地在材料中找到. (3) 所有的文件均提交複印件, 但I-485的結婚證與出生證需提交公證原件, 否則會要求補件.
因為許多中文材料需翻譯成英文, 所以在Exhibits之前要加上一頁, 請任何一位懂中英文的朋友簽字就行. 此人無需具有律師或公證員的資格. 格式如下:
