The interpreation of 245(k) is much more compliated then. The let's do a narrow one.
1. When you file 485, you are present in the US and you entered the US legally (inspect by an INS officer).
2. You have not been violate your status for over 180 days
3. You are an GC seeker under ceterain EB categeories.
You do not have to be in status when you file 485.
There are other interpretion or implication of 245(k)
