U are talking about 245(i)

It's not called 245 waiver. Waiver is generally for people who has a USC immediate relative (parent, spouse, children). they were under different sections of INA.

The only exemption for people who worked w/o au,overstayed, or entered illegally to be able to AOS is under section 245(i), not under any other sections of 245 unless u were married to a USC.

To be eligible for 245 (i). U had to be in the US in 2000 (proof of residence), and an immigration visa petition (I140, 130), or a LC was filed for u on or before April 30, 2001.

If u were eligible under 245(i), when u file 485, u also need to file 485A and pay $1,000.
