About EB1-OR ---- To Xiaobaitu, Radiology, WorthIt or anyone who

I’m a postdoc in a private research institute. I have a very basic question about EB1-OR. I know it has to be sponsored by the employer. In my case, I’m not sure who my employer is. Is it my boss or the institute who pays me? My job title is “Research Associate”. My lawyer said this is a permanent position, but I doubt that the human resource of my institute will provide me such a letter saying my position is permanent. If they can’t give me the letter, can I ask my boss to write such a letter for me? He’s an investigator of this institute (but not hired by them), and he pays me using the research funding provided by this institute. Everyone knows that postdoc is not a permanent job, but I heard some postdoc get sponsored by their university or institute. Is it dependent on different policy in different school? I’m also thinking about EB1-A, but the requirement is really high and I’m not very confident. Is EB1-OR easier than EB1-A? Many thanks if anyone can give me an answer.
