I am going to file I-140 under the both catagories of Eb-1 and NIW, and I-485 slightly late. The lawyer whom I consulted with told me that I could only assocaite I-485 to one catagory of I-140, that is, either Eb-1 or NIW. The drawback is obvious: For example, if I bound Eb-1 with I-485, but finally get NIW approved while Eb-1 denied, I will have to file I-485 once again.
Could you please kindly tell me whether this information is correct? This could be important because, if a lawyer does not understand the law well, he might not be qualified.
