But of course, if you want to divorce, you can divorce. You can call police for domesitic violence, and even if ICE(INS) is notified, very little chance you will be withheld. You will most likely be released by INS on your own and continue the illegal immigrant life in US. And you are still mother of your child, your being illegal and child's being US citizen doesn't affect your right as a parent.
