Don't bother to ask your previous employer. 10 days out of status is not a big deal. USCIS knew that the no grace period for H1 regulation is rediculous so they generally not take it very seriously. I once out of status for more than a month, still got my new h1. if you want to be safe you can a b2 application yourself. as soon as you received your new H1 receipt wite a letter to revoke the B2 application.
Personally I don't hink it's a big deal have 10 days gap or even 20 days gap.
