1. The date you your NIW.
2. If you are no H/L, the answer is NO if you do not use EAD. If you are on F/J, you may lose your status right after filing 485. After you used your EAD, you have to leave if your 485 is denied and you decide not to appeal the decision.
3. You lawyer is right generally. However the reference letter for NIW and EB1 is usually a bit different.
