You don't need to argue each other here. Just get a copy of IRS Pub 519 and 901. Everything is clearly stated over there. The point is that American is not familiar with tax return filed by foreigner. You are the only one who is responsible for your income tax return. I once went to IRS local office to ask questions regarding Pub 519, and what a surprice, this is the first time the IRS employee know the existance of Pub 519. So you need to read it yourself. If you're planning to stay here (to get green card), pay the taxes if you're on H visa (you might get away with it for now. You will get trouble when you apply for green card). You may choose not to pay taxes until the third year of your stay. Again if you're planning to stay, the ss tax payment will affect your benefits later on. And if you decide that you will not stay here. You don't need to pay the tax even after the time limit since you don't care any consequence. Good luck,
