J-2 status

I am J-1, H-1B already approved, start at 7/1/2006. My wife is J-2, is filing H-1B petition by her employer's lawyer but not ted yet. Waiver approved, DS-2019 expires 10/30/2006. The lawyer told me my wife has status problem, cannot apply H-1B, try to fix by filing H-4 but no guarantee. Please give me some advice on how to solve the problem, any input is apprreciated.
