由於可能的eb2的再次倒退, 越來越多的申請人開始對eb1-a產生了興趣. 大家都想知道自己是否符合eb1-a的要求?, 或者該不該試一試?, 被批的可能性有多大? 是否需要請律師? 在此提出我個人的意見供大家參考 (兼答一些網友的谘詢). 希望能起拋磚引玉的作用.

在相關的文件中(或見140說明), 你可以找到下麵的有關eb1-a 的要求.

to qualify as an alien of extraordinary ability in the sciences, arts, education, business, or athletics, the law requires the applicant to some of the following evidence to prove that the alien has sustained national or international acclaim and that his or her achievements have been recognized in the field of expertise. the regulations require submission of

1. the evidence of a one-time achievement (that is, a major, internationally recognized award), or

2. at least three of the following:

1) evidence of the alien's original scientific, scholarly, artistic, athletic, or business- related contributions of major significance in the field;

2) evidence of the alien's authorship of scholarly articles in the field, in professional or major trade publications or other major media;

3) published material about the alien in professional or major trade publications or other major media, relating to the alien's work in the field for which classification is sought. such evidence shall include the title, date, and author of the material, and any necessary translation;

4) documentation of the alien's receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavor;

5) documentation of the alien's membership in associations in the field for which classification is sought, which require outstanding achievements of their members, as judged by recognized national or international experts in their disciplines or fields;

6) evidence of the alien's participation, either individually or on a panel, as a judge of the work of others in the same or an allied field of specialization for which classification is sought;

7) evidence that the alien has performed in a leading or critical role for organizations or establishments that have a distinguished reputation;

8) evidence of the display of the alien's work in the field at artistic exhibitions or showcases;


9) evidence that the alien has commanded a high salary or other significantly high remuneration for services, in relation to others in the field; or

10) evidence of commercial successes in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales.

一般來說, 大家都不具備a one-time achievement (a major, internationally recognized award). 所以申請人要做的是在所列的其他10個條件中, 對照自己的條件, 看一看自己能符合幾條. 對於大多數作研究的人來說, 能夠值得大做文章的也就是條件 1), 2), 和 3). 條件4), 5), 6), 和 7) 因人而異, 越多越好, 除了給予適當的描述, 讓移民官了解它們得來不易之外, 你無法再做其他的發揮. 條件8), 9), 10), 適用於搞藝術的申請人, 對大部分搞研究的人來說, 是可望不可及的事.

那麽該不該試一試?, 被批的可能性有多大? 是否需要請律師?

一般來說, 隻要符合任何3條 或3條以上,都可以值得一試. 畢竟每個人的運氣都不一樣. 如果你自己做的話, 萬一被拒, 最多也就是損失一點申請費. 如果你請律師做, 那就要慎重一點, 除非你錢多的燙手.

對於大多數搞研究的人來說, 如果你能符合條件 1), 2), 和 3) 中的2條, 條件4), 5), 6), 和 7)中的二條或二條以上, 你就可以放心大膽的試一把.

關於請律師的問題, 因每個人情況不同, 很難有統一的答案. 要根據你的經濟情況, 時間, 精力, 和你對移民知識了解和移民進展的情況來決定. 律師的主要任務就是準備申請信 並提供指導收集其他材料. 如果你能找到經驗豐富,而有負責的律師, 那是你的福氣. 如果律師不願接你的案子或者你不想雇傭律師, 那你得自己動手, 借助一個好的diy pkge,你可以同樣充滿信心去準備你自己的case. 好的diy pkge應該是一次成功的, 如果是有rfe的, 覺得還是慎重的好, 除非你也準備等著rfe的通知. to hire a lawyer or diy, it is up to you.

關於推薦信的問題, 找人寫推薦信的確是一件很痛苦的是, 如果你已辦過niw, 那麽用於辦niw的材料和推薦信的複印件,完全可以用來準備你的eb1 case. 無需再另外索要推薦信. 當然申請信需要重新寫, 因為eb1的要求和niw是不完全一樣的.
