Please Help; I-485 Pending & AP入境

主申請人已經回中國，H1-B 將在07年1月過期，I-140 已批。I-485 Pending.

如果不Renew H１，副申請人(H4)申請AP,在07年１月份用AP入境，會有問題嗎？
